1 Earl Diehl appeals from a judgment convicting him of theft by contractor. He also appeals from an order denying his motion for post-conviction relief. He argues: (1) that the complaint did not adequately allege all of the elements of the crime; (2) that the jury instructions did not address all of the elements of the crime; (3) that he received ineffective assistance of counsel; (4) that the circuit court erred in allowing a police detective to testify by telephone; and (5) that the evidence was insufficient to support the conviction. We affirm.
